04/ 28.08.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Govindpur P.S. Case No. 211 of 2025, registered under sections 303(2), 317(2), 3 (5) of BNS, 2023 and Rule 13 of Jharkhand Minerals (Prevention of illegal Mining Transportation and Storage) Rules, 2017, section 21 of Mines and Minerals (Development & Regulation) Act, 1957, under Rule 54 Jharkhand Miner Minerals Concession Rule, 2004, pending in the Court of learned Judicial Magistrate, Ist Class, Dhanbad.

Learned counsel for the petitioner submits that allegation is made that petitioner was helping the driver in loading the coal on the truck. He submits that the petitioner has one criminal antecedent. He submits that one of the co-accused has been granted anticipatory bail in A.B.A. No. 4149 of 2025 who happens to be owner of the truck. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are made that petitioner was helping the driver in loading the coal on the truck.

Considering that petitioner is having one criminal antecedent and one of the co-accused has been granted anticipatory bail in the aforesaid A.B.A. and it has been pointed out that petitioner was helping the driver in loading the coal on the truck, the petitioner is directed to surrender before the learned court within two weeks from the date of receipt/production of a copy of this order and the learned court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper.
6. This anticipatory bail application is disposed of.
