The applicant has preferred this First Bail Application under Section 483 of the BNSS in connection with Crime No. 179/2025, registered at Police Station – Civil Line Rampur, District Korba (C.G.) for the offence punishable under Sections 331(4), 305(A), 111 & 317(4) of the Bhartiya Nyaya Sanhita, 2023. 2. That, as per the prosecution story brief is that the complainant has lodged an FIR against the unknown person stating that the unknown persons had made theft jewellery from his house. VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.07.07 10:35:15 +0530 2 Thereafter the police has registered the FIR against the unknown person, after investigation police has arrested the co accused person, on the basis of the memorandum of co accused person the present applicant and other accused person implicated in this case. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submits that the applicant is aged about 21 years and as per memorandum of other co-accused person the present applicant has been implicated in this case. He further submits that applicant has not committed theft unnecessary the same police station has registered two case except in this case and complainant has not identified of the theft article, he is in jail since 11.04.2025, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, the learned counsel for the State opposes the bail application. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case, the nature and gravity of the offence, the material available in the case diary, and the fact that the applicant committed theft of jewellery and sold it to a co-accused person, and that the crime was organized by them, therefore, this is not a fit case to grant regular bail to the 3 applicant. 7. Therefore, the bail application filed by the applicant/accused – Nitesh Sahu involved in Crime No. 179/2025, registered at Police Station – Civil Line Rampur, District Korba (C.G.) for the offence punishable under Sections 331(4), 305(A), 111 & 317(4) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 8.
