BONU RAMA SHANKAR RAO Counsel for the Respondent/complainant: 1.PUBLIC PROSECUTOR The Coult made the following Order: The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioner herein/A3 to gran.I anticipatory bail in connection with crime No.431 of 2022 of Special Enforcement Bure'au, parvathipuram, vizianagaram District, registered for the offences punishable under Sections 7(B) r/w 8(B) of the A. P. Prohibition (Amendment) Act, 2020. 2 2. Case of the prosecution, in brief is that on 22.ll.2022, on receipt of reliable information, the Enforcement Inspector, along with' his staff proceeded to Godaba Gowramma of Pedabondapalli Village, Parvathipuram, and found one male person and one female person'with bags. On seeing the police party, the accused escaped from the scene of offence. The Enforcement Inspector verified the place and found two plastic bags containing 500 lD liquor sachets. The contraband along with other material was seized under the cover of occurrence report and a case was registered against the accused. 3. Heard. Perused the record. 4. Learned counsel for the petitioner contends that, even according to the prosecution's case, no property was seized from the possession of the petitioner. Moreover, the occurrence report is silent with regard to the particulars of the persons from whom the Investigating officer made inquiries. Thus, the case against the petitioner is based solely on.the hearsay version of the I-nvestigating Officer. 5. Learned Assistant Public Prosecutor vehemently opposed to grant anticipatory bail to the petitioner and submitted that the petitioner herein has no previous crime record. 6. A perusal of the occuITenCe report goes tO Show that nO Property was seized from the possession of the petitioner herein. It submitted by the learned counsel for the petitioner that most of the witnesses are _ ----,-.- +A 3 official witnesses and granting of anticipatory bail to the petitioner would not hamper the investigation. 7. ln view of the facts and Circumstances Of the Case, this Court is inclined to grant anticipatory bail to the petitioner herein, on the following conditions. (i) The petitioner herein is directed tO Surrender before the Station House Officer concerned, within a period Of two (2) weeks from the date of receipt of a copy of this order. On such surrender, the petitioner herein is ordered to be enlarged on bail on his executing a personal bond for Rs.10,000/-(Rupees ten thousand only) with one surety for the like sum each to the satisfaction of the Station House Officer concerned. (ii) The petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses. 8.
