This Criminal Appeal is filed by the appellant, who was the accused in Sessions Case No.253 of 2013 on the file of Family Court-cum-IX Additional District and Sessions Judge, East Godavari District at Rajahmundry (for short, “Sessions Judge”), challenging the judgment, dated 28.05.2014, whereunder the learned Sessions Judge convicted the accused for the offence punishable under Section 304 Part-I of Indian Penal Code, 1860. 2. Today, when the matter is taken up for hearing, learned Assistant Public Prosecutor representing Respondent-State submits that the Superintendent of Jails, Central Prison, Rajamahendravaram submitted information stating that the Convict No.3045-Marigela Seema Reddy, S/o. Boddayya, who is appellant herein, was expired on 20.06.2019 at about 1.00 P.M. at Government General Hospital, Kakinada. 3. A perusal of the said report and the death of the appellant/accused, this Court views that the appeal is liable to be abated. 4. Accordingly, the Criminal Appeal is dismissed as abated.
