The petitioner, who is facing trial for an offence punishable under Section 138 of the Negotiable Instruments Act, is before this Court challenging the order passed by the Trial Court issuing a non-bailable warrant to secure his presence. 2. The petitioner states that he is a permanent resident of the State of Odisha and was not aware of the proceedings pending against him. After service of summons, and before he could engage a counsel, the Trial Court issued the non-bailable warrant. The petitioner undertakes to appear before the Trial Court on the next date of hearing and to attend regularly as and when summoned. 3. The undertaking is placed on record. 4. In view of the above, it is appropriate to quash the impugned non-bailable warrant issued against the petitioner. ORDER i. The impugned order dated 01.12.2023 passed by the IX Additional Judge, Small Causes Court, City Civil Complex, Bengaluru in CC No. 3123/2023 is hereby set aside, and the non-bailable warrant issued against the petitioner is recalled, subject to the petitioner appearing before the trial Court on the next date of hearing and regularly thereafter, as and when summoned.
