Neutral Citation No. - 2025:AHC:28305 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 2040 of 2025 Petitioner :- Devendra Singh Respondent :- The State Of U.P. And 3 Others Counsel for Petitioner :- Umair Alam Counsel for Respondent :- C.S.C. Hon'ble Rohit Ranjan Agarwal,J. This is plaintiff's petition. In a suit filed by the plaintiff-petitioner against the defendant-respondents, an application for grant of temporary injunction was moved which was rejected, against which a Misc. Appeal No.5 of 2021 was preferred before the appellate Court which was dismissed for want of prosecution. A restoration application No.111 of 2021 was filed which is pending consideration. The sole prayer made in the writ petition is for expeditious disposal of the restoration application No.111 of 2021. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Court concere3d to decide the Restoration Application No.111 of 2021 (Devendra Singh vs. Surendra Singh & Ors.) filed in Misc. Appeal No. 5 of 2021, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
