Petitioners herein, who were appointed as Duty Incharge cum Supervisors against the newly created post of District Emergency Operation Centre, Keylong vide office order dated 18.7.2017 issued by the Deputy Commissioner Keylong, Lahaul and Spiti, Himachal Pradesh, have approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide their representations (Annexure P-12), whereby they have prayed for regularization in terms of policy of regularization framed by the Government of Himachal Pradesh, wherein it has been decided that all
- 2 - contractual employees shall be entitled to regularization after having rendered three years service on contract basis. 2. Having regard to the nature of order proposed to be passed, this court sees no necessity to call for reply from the respondents, who are otherwise represented by Mr. Rajan Kahol, learned Additional Advocate General, who states that representation, if any, shall be decided expeditiously. 3. Careful perusal of averments contained in the petition as well as documents reveal that petitioners herein were given appointment against the post of Duty Incharge/Supervisor for the period of one year against newly created office of District Emergency Operation Centre, Keylong, vide Office order dated 18.7.2017 issued by Deputy Commissioner Keylong (Annexure P-6). Though initially petitioners herein were given appointment for the period of one year, but subsequently, their contract came to be renewed from year to year basis as is evident from the copies of contract placed on record by the petitioner. Lastly, the services of the petitioners have been extended vide order dated 24.7.2025. it is also not in dispute that vide notification dated 22.4.2020 (Annexure P-11), Government of Himachal Pradesh has decided that services of contractual employees who have completed three years continuous service as on 31.3.2020, shall be regularized.
If it is so, claim of the petitioners, who admittedly have been working on contract basis for more than seven years, are
- 3 - entitled to be granted benefit in terms of aforesaid notification dated
22.4.2.020. 4. Since petitioners herein have already approached the respondents by way of representation (Annexure P-12), this Court without going into the merits of the case, deems it fit to dispose of the present petition with a direction to the respondents to consider and decide afore representation of the petitioner in terms of notification dated 22.4.2020 (Annexure P-11) expeditiously, preferably within a period of six weeks. Needless to say, in the event of petitioners being found eligible for regularization in terms of notification dated 22.4.2020, necessary orders shall be passed without any further delay. Pending application(s), if any, also stands disposed of. January 5, 2026
