Phukan, learned counsel appearing for the petitioners in AB No. 704/2025 and AB 686/2025 and Ms. D. Pathak, learned counsel appears for the petitioner in AB No. 869/2025. Mr. K. Baishya, learned Additional Public Prosecutor, Assam is representing the State Respondent. 2. By these applications filed under Section 482 of the BNSS, 2023, in AB No. 704/2025 the petitioner Miranda Tap; in AB No. 686/2025 the petitioner Sri Prasenjit Hazarika and in AB No. 869/2025 the petitioner Purabi Pathak, have prayed for privilege of pre-arrest bail, who apprehend arrest in connection with Dispur P.S. Case No. 189/2025. 3. The petitioners had been granted interim protections by this Court to appear before the Investigating Officer to participate in the investigation process. It is stated that all the petitioners have appeared before the Investigating Officer and participated in the investigating process. 4. The learned counsel for the petitioners has submitted the order dated 23.10.2025 passed in AB No. 704/2025 arising out of the same FIR, in which it has been noted by this Court that the funds which allegedly did not tally, had happened due to mechanical fault in the ATMs and not due to misappropriation. 5. Keeping all the above in view, this Court is of the opinion that the privilege of pre-arrest bail granted to the petitioners on earlier occasions can be made absolute. 6. Therefore, the interim order dated 27.03.2025 granted to the petitioner Miranda Tap; the interim order dated 25.03.2025 granted to the petitioner Sri Prasenjit Hazarika and the interim order dated 11.04.2025 granted to the petitioner Sri Purabi Pathak, are made absolute. 7.
