1.PUBLIC PROSECUTOR The Court made the f'ollowing: ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya E= I Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/Al to iE± r\
< 2 A3, seeking bail, in Crime No.64/2025 of Al'agadda Rural Police Station, Nandyal. 2. A case has been registered against the petitioners and others for the offences under sections 118(1 ),109(1 ) r/w 3(5) B.N.S,
3. Case of the prosecution, in brief, is that, on the intervening nightof 12.5.2025 and 13.5.2025 at around 1:30 am, at Kasireddy Nayana Ashramam road near swathi Guest House, Ahobilam village, the petitioners along with one other accused allegedly attacked the de facto complainant, one Ragiri Praveen Kumar, causing him certain injuries. Basing on the complaint of the defacto complainant, F.I.R came {o be registered and the accused were arrested on 14.5.2025 and remandec] {o judicial custody. 4. Learned counsel for the petitioner contended that the pet'ltioners were arrested on 14.5.2025 and most of the investigation is completed and the 3rd petitioner is a student pursuing Degree course and they have permanent abode and prays to enlarge them on bail. 5.
On the other hand, learned Assistant Public Prosecutor opposed the bail application and stated that some more witnesses are to be examined and if the accused were released on bail, they may tamper the evidence and hamper the investigation. 6, Heard both sides. .rf3-. 7. A perusal of the record indiCateS{hatthe Offence Said tO have been occurred on the intervening night of 12.5.2025 and 13.5.2O25. The wound certificate placed by the learned Assistant Public Prosecuto:gpo, shows that the injuries sustained by the defac{o complainant are simple in nature and admittedly there 'ls no danger to the life of the defacto complainant. The petitioners have nO antecedents aS Stated by the learned Assistant Public Prosecutor. As the incident said tO have occurred on the intervening night of 12.5.2025 and 13.5.2O25, by this time, most of the investigation might have been completed and the petitioners have been in judicial custody from 14.5.2025. It is not the case of the prosecution that custodial interrogation of the petitioners are required for conducting further investigation. The petitioners have got permanent abode in Kurnool District. 8. In view of the aforesaid facts and Circumstances Of the Case, this court is inclined to grant bail to the petit'loners/Al to A3 with the following conditions. (i) The petitioners/Al to A3 herein shall be released On their executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) each with two suret|les for a like sum each to the satisfaction of the learned V Additional District and sessions Judge, AIIagadda; (ii) on release, the petitioners shall appear before the Station House Officer concerned on every Sunday between 10.00am to 1.00pm for a period of three (03) months; - iE Fig
