Before the trial court, the petitioner filed the petitions to condone the delay of 61 days in preferring the complaints under Sec.138 of Negotiable Instruments Act and the same were dismissed by the trial court holding that no specific reason stated for the delay. Aggrieved over that, the petitioner/complainant preferred these Criminal Revision Cases. 3. The learned counsel for petitioner would submit that due to lack of communication from his counsel, he was not able to present the complaints within a stipulated time. Hence, he prayed to set aside the findings of trial court. 4. On perusal of records, it reveals that due to lack of communication from his counsel, the petitioner/complainant unable to file the complaints before the trial court, however, for the fault of advocate, litigant cannot be prejudiced and the reason for the delay was also specifically assigned, but it was not considered by the trial court. Therefore, this Court is inclined to allow these Criminal Revision Cases and the findings rendered in Crl.M.P.Nos.17 and 16 of 2025, 1756 & 1880 of 2024 is set aside.
