THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE H.P.SANDESH ORAL ORDER This Court vide order dated 27.05.2022 suspended the sentence subject to depositing of 40% of the fine amount including the amount already deposited, if any, in the Trial Court within two weeks. 2. The learned counsel for the respondent submits that said order is not yet complied even after lapse of two years nine months. 3. Today, the learned counsel for the petitioner seeks time. 4. When the matter was listed before the Court on 18.07.2022, PF was not paid but moved the matter filing a memo and hence, this Court granted three days time to pay the PF imposing cost of Rs.500/-. Again the matter - 3 - NC: 2025:KHC:7402 CRL.RP No. 750 of 2022 was listed on 25.08.2022 and two weeks time was granted to do the needful. When the matter was listed on 17.11.2022, the counsel for the petitioner sought a week’s time to pay PF and this Court on perusal of the police report, a week’s time was granted as prayed and also directed to take notice on the counsel at the address shown in the notice as well as on the counsel appearing for the respondent before the Trial Court by hand and to file a comprehensive affidavit along with acknowledgment with the registry within ten days. Inspite of sufficient time granted also not deposited the amount as ordered by this Court while suspending the sentence. When order has not been complied even after lapse of two years nine months, question of granting time again does not arise. Accordingly, the petition is dismissed. Sd/- (H.P.SANDESH) JUDGE SN
