The appellants/defendants have filed this second appeal under Section 100 of CPC against the judgment and decree dated 18.01.2017 passed by the learned Second Additional District Judge, Bilaspur, District Bilaspur (C.G.) in Civil Appeal No. 183-A/2014 by which the learned appellate Court has dismissed the appeal by affirming the judgment and decree dated 15.01.2013 passed by the learned Civil Judge, Class-II, Takhatpur, District Bilaspur (C.G.) in Civil Suit No. 64-A/2011 by which the learned trial Court allowed the suit filed by the plaintiff. 2. Learned counsel for the appellant on instruction would submit that the parties have already settled their issue, therefore, he does not intend to continue with the appeal. 3.
