3 The Court made the following order: The petitioners are arraigned accused Nos.1 & 2 in C.C.No.39 of 2025 on the file the Additional Junior Civil Judge, Filer, of for the alleged offence under Sections 337 of IRC, Sec.134 (a)(b) r/w 187, Sec.3 r/w 181, Sec.5 r/w 180 of the Motor Vehicle Act. The 1®* petitioner is the driver of the tipper lorry and the 2""^ petitioner is the owner of the tipper lorry. rtd

As seen from the charge sheet, the allegation against the 2 respondent is that, he motivated the 1®* petitioner to drive the tipper lorry, though he did not possess license for driving the tipper lorry. The police have investigated into the matter by recording the statements of five witnesses, medical officers, apart from the investigating officers. 3. Prima facie, this Court does not find any ground to interfere in C.C.No.39 of 2025 on the file of the Additional Civil Judge-cum- Judicial Magistrate of First Class, Filer. 4.
