The appellant has filed the instant appeal under Section 19(1) of the Family Court Act, 1984 against the impugned judgment & decree VISHAKHA BEOHAR Digitally signed by VISHAKHA BEOHAR 2 dated 03.05.2024 passed in Civil Suit No. 88A/2023 (Vishnu Tandon vs. Smt. Shashi Tandon) passed by the learned Family Court, Mungeli, District Mungeli (C.G.) whereby the learned Family Court allowed the petition filed by the respondent-husband under Section 13(1)(a) of the Hindu Marriage Act and has dissolved the marriage solemnized between the appellant-wife and respondent-husband herein. Therefore, the present appeal filed by the appellant. 2. During the pendency of appeal both the parties agreed for amicable settlement and vide order dated 02.01.2025, the matter was referred to Mediation Centre of this Court and both parties have settled their dispute before the Mediation Centre on the same day, wherein statements of both the parties got recorded and compromise was arrived at between the parties in terms of the settlement agreement dated 02.01.2025, which was duly signed by them. 3. Learned counsel for the parties jointly submit that the aforesaid agreement has been arrived at between the parties without any pressure or coercion and the same is out of their own free will, whereby they have amicably resolved the dispute before the Mediation Centre of this Court and therefore, the present appeal may be disposed of in terms of the aforesaid agreement dated 02.01.2025. 5. We have heard learned counsel for the respective parties. 6. In view of the submissions made by learned counsel for the parties and looking to the terms and conditions of the agreement dated 02.01.2025 arrived at between them, accordingly judgment and decree dated 03.05.2024 passed in Civil Suit No. 88A/2023 (Vishnu Tandon vs. Smt. Shashi Tandon) passed by the learned Family Court, Mungeli, 5 District Mungeli (C.G.) is hereby set-aside and the present appeal is disposed of in terms of the said agreement. The terms of the agreement will form part of this judgment and decree. 7. Let a decree be drawn up accordingly. 8. Interlocutory application(s), if any pending, shall stand disposed of.
