Heard the parties.
Learned counsel for the petitioner submits that this interlocutory application has been filed with a prayer for early hearing of this anticipatory bail application. Since, this anticipatory bail application is taken up today hence, the prayer has become infructuous. Accordingly, this interlocutory application is disposed of being infructuous. (Anil Kumar Choudhary, J.) A.B.A. No. 5658 of 2024
1. Heard the parties. 2. Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Sakchi P.S. Case No.89 of 2024 registered for the offences punishable under sections 147/ 148/ 149/ 341/ 323/ 307/ 504/ 506 of the Indian Penal Code and under Section 27/35 of Arms Act. 3. The Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was member of unlawful assembly and in prosecution of the common object of the assembly attempted to murder the informant. It is further submitted that the allegations against the petitioner are all false and drawing attention of this Court to Annexure-2 at page no.15 of the brief which is the copy of the certified copy of the compromise petition, submits that the matter has amicably been settled between the parties and the informant is not interested in contesting the case. It is then submitted that both the parties are residing in the same locality and because of some misunderstanding, the informant has lodged the FIR. It is then submitted that the petitioner undertakes to furnish sufficient security including cash security and also undertakes to cooperate with the investigation of the case and further undertakes that he will not annoy or disturb the informant in any manner during the pendency of the case. Hence, it is submitted that the petitioner be given the privilege of anticipatory bail. 4. Learned Addl. P.P. opposes the prayer for grant of anticipatory bail. 5. Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that it is a fit case where the abovenamed petitioner be given the privilege of anticipatory bail. Hence, in the event of his arrest or surrender within a period of six weeks from the date of this order, he shall be released on bail on depositing cash security of Rs. 20,000/- and on furnishing bail bond of Rs.
25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamshedpur, in connection with Sakchi P.S. Case No.89 of 2024 with the condition that the petitioner will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the pendency of the case; with further condition that he will not annoy or
disturb the informant in any manner during the pendency of the case and further conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Anil Kumar Choudhary, J.)
