JUSTICE RAJNESH OSWAL, JUDGE ORDER 03.09.2025 1) Being aggrieved of the order dated 29.01.2023 issued by the respondents, whereby name of the private respondent was proposed for appointment as Lumberdar for Village Chak Mathyani Tehsil Taryath District Rajouri, the petitioner filed a writ petition bearing WP(C) No.616/2023 for quashing of the said order and for directing the official respondents to conduct election for the post of Lumberdar of the aforesaid village. The learned Writ Court dismissed the writ petition vide order 25.09.2024, which is under challenge in the present appeal. LPA No.38/2025 2 | P a g e 2) Pursuant to the notice of this Court, the official respondents have filed their response stating therein that the order dated 29.01.2023 was issued by the official respondents as they were unable to hold elections due to the interim direction issued vide order dated 08.11.2017 passed in OWP No.1809/2017. 3) Learned counsel for the appellant has submitted that the present appeal can be disposed of by directing the official respondents to hold election for the post of Lumberdar for Village Chak Mathyani Tehsil Taryath District Rajouri within some stipulated period. 4) The suggestion put forth by learned counsel for the appellant was not opposed by Miss Monika Kohli, learned senior AAG. 5) In view of the above, the present appeal is disposed of by directing the respondents to hold elections for the post of for Village Chak Mathyani Tehsil Taryath District Rajouri within a period three months from the date of receipt of this order.
