4/01.09.2025 Heard learned counsel appearing on behalf of Petitioner and learned SPP appearing on behalf of the State.
2. The petitioner is apprehending his arrest in connection with Complaint Case No. 1585 of 2019, registered under sections 33 (1) (C) of the Indian Forest Act, pending in the Court of learned Judicial Magistrate, 1st Class, Chatra.

Learned counsel for the petitioner submits that false allegation has been made that after entering into the forest area, the petitioner has cut the poppy plant. He submits that petitioner has no criminal antecedent which is disclosed in para 14 of the petition. He further submits that on identical situation, three co-accused persons have been granted anticipatory bail in ABA No.4502 of 2025 by this Court by order dated 18.08.2025. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegation of entering into the forest area and cut the poppy plant is there.

5. Considering that petitioner has no criminal antecedent which is disclosed in para 14 of the petition and even the land is of the forest department and the identical situation co-accused persons have been granted anticipatory bail, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Chatra, in connection with Complaint Case No. 1585 of 2019, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
7. This Anticipatory Bail Application is accordingly disposed of.
