The applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending her arrest in connection with Crime No.78/2025, registered at Police Station Bilaigarh, District Sarangarh-Bilaigarh (C.G.) for alleged commission of offence punishable under Sections 296, 191(2), 191(3), 190, 115(2), 351(2) and 331(6) of the Bharatiya Nyay Sanhita, 2023. 2. As per the prosecution story in brief, the applicant assaulted the complainant by hand and lathi after entering into his house and also used filthy language against him and thereby committed the offence. Learned counsel for the applicant has argued that the applicant is completely innocent and further submitted that no single evidence has been collected by the prosecution which shows that the applicant is involved in the offence. He further submits that co-accused Susmita Dhirhe has already been granted anticipatory bail by this Court vide order dated 13-5-2025 passed in M.Cr.C.(A) No.734/2025 and therefore the present applicant is also entitled for same benefit on the ground of parlity. 4. On the other hand, learned State counsel opposes the bail application of the applicant herein. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant, and also considering that co-accused Susmita Dhirhe has already been granted anticipatory bail, at this stage, without expressing any opinion on merits, this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case. 7. Accordingly, the instant bail application is allowed and it is directed that in the event of arrest of the applicant – Sukrita alias Sunita Bandhe on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be {M.Cr.C.(A)No.745/2025} prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (d) The Applicant and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
