---- 03/26.08.2025 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Bariyatu P.S. Case No.66 of 2024, for the alleged offences registered under Sections 18(b) and 22(b) of NDPS Act pending in the Court of learned Sessions Judge-cum-Special Judge, NDPS, Latehar.

Learned counsel appearing for the petitioner submits that the petitioner is a farmer/agriculturist and he has some small piece of land in which he does work of agriculture to maintain his family. He submits that false allegation is made of recovery of a bag along with 6.7KG of poppy straw from the field of the petitioner. He submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.13 of the petition. He submits that the said quantity is also intermediary and the seizure list has been signed by police officials only.

Learned counsel appearing for the State opposes the prayer and submits that from the field of the petitioner the said recovery has been made.

Considering that the petitioner is the agriculturist and the allegations are made that from the cultivating land of the petitioner the said recovery has been made and the petitioner has got no criminal antecedent as disclosed in paragraph No.13 of the petition and the seizure list has been signed by police officials only, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Sessions Judge- cum-Special Judge, NDPS, Latehar in connection with Bariyatu P.S. Case No.66 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
