The accused/applicant has moved this first bail application under Section 483 of BNSS, 2023 for releasing him on regular bail during trial in connection with Crime No. 421/2023 registered at Police Station – Gudhiyari, District – Raipur (C.G.) for the offences punishable under Sections 364, 302 and 201 of IPC. The prosecution case, in brief, is that complainant lodged a report to the effect that on the date of incident i.e. 13.09.2023 at about 10:30 pm, the present applicant along with other co-accused persons took the deceased near Kharun River Sarona Bridge, Raipur and after that there was dispute arose between the accused persons and deceased with regard to consuming liquor, thereafter, the accused persons have assaulted the deceased with stone, due to which the deceased died. Based on this, offence has been registered against the present applicant along with other co-accused persons. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He next submits that only on the basis of mere suspicion, the applicant has falsely been implicated in this case. He also submits that the applicant is in jail since 21.09.2023, and only 11 witnesses out of 23 witnesses have been examined till date, and there is no likelihood of his case being decided in the near future, therefore, the present applicant may be released on bail. 4. On the other hand, learned counsel for the State opposes the bail application and submits that as per the postmortem report, there are multiple contusions and abrasions on the body of the deceased and on the basis of 3 the CDR of the mobile of the present applicant, he has been made an accused in this case. Therefore, he may not be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the entire facts and circumstances of the case, particularly looking to the material available on record and the evidence against the applicant, at this stage, I am not inclined to release the applicant on bail. 7. Accordingly, the bail application filed under Section 483 of BNSS, 2023 is rejected. However, concerned trial Court is directed to expedite the trial and to ensure that the trial is concluded as expeditiously as possible. 8.
