PUBLIC PROSECUTOR The Court made the following: 2 ORDER: The Criminal Petition has been filed under Section 438 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.’)/ Sections 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to grant pre-arrest bail to the petitioner/Accused No.2 in Cr.No.33 of 2025 of Steel Plant Police Station, Visakhapatnam City, registered against the petitioner/Accused No.2 herein and another for the offences punishable under Sections 118(2) of Bharatiya Nyaya Samhitha (for brevity ‘BNS’) 2. The case of the prosecution is that, prior to 05.5.2025, at Ukku stadium, Sector-7, Ukkunagaram, wherein the de facto complainant stated that she is residing along with her family in Ukkunagaram. Her elder son who is aged about 19 years studying Mechanical Diploma and preparing for competitive examinations. On the same day at about 6.00 pm the friend of his son dropped his son at walking track, RINL Town ship and then he went to ukku stadium for walking, but did not return back to her house. Herself and her relatives searched the surrounding areas but in vain. Hence the F.I.R. 3. Sri Challa Srinivasa Reddy, the learned counsel for the petitioner, submits that the petitioner is no way concerned with the crime and he was falsely implicated in this case and urged to grant pre-arrest bail to the petitioner. 4. Per contra, Mr.Neelotphal Ganji, the learned Assistant Public Prosecutor, opposed in granting of bail and submitted that the investigation is 3 still going on and some more witnesses are to be examined. There are three cases registered against the petitioner. 5. Perused the record. 6. As seen from the averments in the record, there are three cases registered against the petitioner vide Crime No.16/2021, 9/2022 and 231/2023 of different police stations. There are specific allegations against the petitioner that himself with other accused way laid the son of the de facto complainant and pushed him onto bushes and questioned him for being in love with one Loukya. In the meanwhile, accused No.1 beat him with a stick on his head for which the son of the de facto complainant fell unconscious. As seen from the Section 164 of the Cr.P.C. statement of the victim, the victim spoken about the role played by the petitioner in the case. There are no merits in the criminal petition and the Criminal Petition is liable to be dismissed. 7. Accordingly, the Criminal Petition is dismissed. However, on the request of the learned counsel for the petitioner, liberty is given to the petitioner to surrender before the concerned jurisdictional Magistrate Court, within 15 (fifteen) days from today, and move an application for bail and on such filing of the application for bail, the concerned jurisdictional Magistrate is directed to consider the same and pass appropriate orders on its own merits and in accordance with law. _________________________ DR.
