W.P.(MD) No.24596 of 2023 O R D E R This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to cancel the patta in Survey Nos. 580/2, 581 and 564, which was unlawfully changed in the name of the Government and consequently directing the first respondent to restore the patta (pattayam) in respect of Survey Nos.580/2, 581 and 564 in the name of the petitioner’s predecessor, Chokkayeeammal. 2. The case of the petitioner is that the petitioner and others are the absolute owners of the lands comprised in Survey Nos.580/2, 581 and
564. According to the petitioner, the lands were originally endowed by ancient kings in the name of one Chinnapillai and thereafter devolved upon successive generations by inheritance in accordance with law. The petitioner is the great-grandson of one Venkatchellampillai, who was settled with the said property by one Chokkayeeammal vide a registered Settlement Deed dated 30.05.1953. The patta (pattayam) had already been granted in her favour. 3. W.P.(MD) No.24596 of 2023 name of the Government. Therefore, the petitioner submitted a representation dated 06.10.2021 to the respondents. 4. The learned Additional Government Pleader appearing for the respondents submitted that the petitioner’s representation would be considered and appropriate orders would be passed by the first and second respondents within a period of twelve weeks and that if the petitioner produces all the documents to substantiate his case, the request would be considered positively. 5.
Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first and second respondents to consider the petitioner's representation dated 06.10.2021 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The petitioner is at liberty to raise all the contentions raised before this Court before the first and second respondents and file supporting documents. The representation shall be considered and disposed of after conducting an enquiry.
