HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Mob No. 9928296381. ----Petitioner Versus 1. State Of Rajasthan, Through Public Prosecutor. 2. Shri Babu Kathat S/o Shri Gheesalal Ji Kathat, R/o Sirkar, Prabhu Ki Bagiya Ke Aagey, Masuda Road, Beawar, District Ajmer (Raj). ----Respondents For Petitioner(s) : Mr. Rahul Singh Meratwal For Respondent(s) : Mr. Jitendra Singh Rathore, PP HON'BLE MR. JUSTICE ANAND SHARMA Order 03/07/2025 Learned counsel for the petitioner has filed the instant criminal misc. petition with a limited prayer to seek direction against the trial Court for deciding the trial of criminal complaint No. 2409/2018 (878/2019) expeditiously. Learned counsel for the petitioner would submit that evidence of both the parties is complete and the matter is pending only for statement of the accused under Section 313 Cr.P.C. Learned counsel for the petitioner has also pointed out that as per Section 143 Clause (3) of the Negotiable Instruments Act, 1881, provision has been made to conduct the trial expeditiously as possible and an endeavour should be made to conclude the trial within six months from the date of filing of complaint. (2 of 2) [CRLMP-3813/2025] Learned counsel for the petitioner would submit that delay in conclusion of trial causes serious miscarriage of justice and hampers the rights of the petitioner. In the light of facts mentioned in the criminal misc. petition, more particularly looking to the facts that the criminal complaint is pending since 2018, it would be in the interest of justice to direct the trial Court to make an endeavour to conclude the trial expeditiously and as early as possible. The instant criminal misc. Petition stands disposed of accordingly. (ANAND SHARMA),J Neeru/103
