Mr. Deepak Sharma, learned counsel, appears and waives service of notice on behalf of the respondents. 2. This petition has been filed for grant of following relief: - “i). The respondents may kindly be directed to count the service rendered by the petitioner 25.11.2011 to 16.08.2017 on contract basis in view of nature of appointment of order and to pay him the pension and other retirement benefits as per provisions of the 1 Whether reporters of Local Papers may be allowed to see the judgment? - 2 - CCS Pension Rules 1972 w.e.f. 01.05.2025 and Leave Encashment with interest till final payment of the arrears and to pay his pension regularly every month.” 3. Learned counsel for the petitioner submits that the reliefs prayed for and the issue involved in the case have already been adjudicated upon in State of Himachal Pradesh & Anr. Vs. Sheela Devi and others2. Learned counsel for the petitioner states that the petitioner would be content if the case of the petitioner is considered by the respondents in light of the aforesaid judgment. Learned counsel for the respondents has no objection to this prayer. 4. Having regard to above submissions, but without examining the merits of the matter, this writ petition is disposed of by directing the respondents to consider the case of the petitioner in light of the aforesaid judgment and pass appropriate orders in accordance with law, in light of aforesaid decision, within a period of six weeks from the date of receipt of copy of this order. The decision so arrived at, shall be communicated to the petitioner. 2 SLP(C) 10399 of 2020 decided on 07.08.2023 - 3 - Pending miscellaneous application(s), if any, also to stand disposed of.
