"a. Issue a writ of mandamus or any other appropriate writ direction or order, directing the respondents to permit the petitioner to attend for the III B.V.Sc and A.H. Annual Board Examination scheduled from 07.04.2025, without insisting on compliance with the attendance requirements as per the norms of the respondents, as a special case on medical as well as humanitarian grounds, in the interest of justice and equity. b. issue such other directions as may deemed fit by this honorable court in the facts of the case and order for cost of the proceedings in the interest of justice and equity." - 3 - NC: 2025:KHC:14533 WP No. 9833 of 2025 2. Heard the learned counsel for the petitioner and the learned counsel for the respondents. 3. Learned counsel for the petitioner submits that due to health reasons, the petitioner was unable to attend classes and he does not possess the requisite attendance for the purpose of taking up the examination as sought for in the present petition, which is scheduled to commence from 07.04.2025. 4. Per contra, learned counsel for the respondents submits that even for the examination conducted last year also, the petitioner cited the very same health reason and this Court, on purely humanitarian grounds, in Writ Petition No.10148/2024(EDN-EX), had permitted the petitioner to take up the examination vide interim order dated 03.04.2024 and the said petition is pending consideration, even as on today. It is further submitted that the petitioner is not entitled to cite the very same reason even for this year, especially, when he does not - 4 - NC: 2025:KHC:14533 WP No. 9833 of 2025 possess the requisite attendance for the purpose of taking up the ensuing examination. 5. In view of the aforesaid facts and circumstances, the petitioner having not possessed the requisite attendance, the question of granting any relief to him in the present petition does not arise.
