The application has been filed for recalling the order dated 06.10.2023 passed by this Court whereby, S.B. Civil Contempt Petition No.1136/2022 was dismissed as withdrawn with liberty to the petitioners to get the contempt petition revived subject to decision of the Hon’ble Supreme Court of India in Special Leave Petition (Civil) Diary No.35596/2023.
Learned Counsel for the applicant/petitioner, inviting attention of this Court towards the order dated 24.02.2025 passed by Hon’ble Apex Court in the aforesaid case, would submit that since, the special leave petition preferred by the respondent-State was dismissed, the contempt petition is required to be restored to its original number. Heard. Considered. The contempt petition was dismissed vide order dated 06.10.2023 as there was an interim order dated 18.09.2023 passed by the Hon’ble Supreme Court of India in Special Leave Petition (Civil) Diary No.35596/2023 preferred against the order contempt whereof was alleged. However, a liberty was extended to the petitioner to get the contempt petition revived if the exigency so warranted. The order of the Hon’ble Supreme Court of India dated 24.02.2025 (Annexure-2) passed in the aforesaid case reveals the special leave petition preferred by the State Government has been dismissed. In view thereof, this application is disposed of in following terms without issuing notice to the respondents/contemnors:
