Heard learned counsels for the parties. The petitioner is the wife of the 4th respondent and alleges that she is being tortured and assaulted by the private respondents, being members of her matrimonial family. She lodged several complaints against the private respondents in this regard. The first complaint has culminated in a charge sheet and subsequent complaints have not been acted upon. Learned counsel for the private respondents denies and disputes the allegations made against them. It appears from the report submitted by the State that pursuant to the complaint lodged by the petitioner, a specific case has been registered and after completion of investigation charge sheet has been submitted. Enquiry 2 was held pursuant to the subsequent complaints lodged by the petitioner and it was found that after 26th August, 2025, the petitioner never returned to her matrimonial home and her subsequent allegations have not been substantiated. Be that as it may, in the event the petitioner is aggrieved by the steps taken by the police authority pursuant to her complaints, she is at liberty to approach the jurisdictional Magistrate under Section 175 of the BNSS. In the meantime, the police authority shall keep strict vigil in the area in order to ensure peace and tranquility and shall render necessary assistance/protection to the petitioner as and when sought. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
