(Oral) The applicant is in judicial custody in FIR No.387 of 2024, dated 14.06.2024, under Sections 147, 323, 308, 504, 506 IPC, Police Station Patelnagar, District Dehradun. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, on 07.06.2024, at 08:00 in the evening, in an altercation between two groups, the applicant along with the co-accused attacked the informant and others, due to which, they sustained injuries. 4. Learned counsel for the applicant would submit that according the witnesses, the applicant exhorted the other co-accused to hit the injured with stone, etc. 2 5. Learned State counsel admits that the injured witnesses have stated so, but according to one of the injured witnesses Mayank, once the injured fell on the ground, the applicant also attacked the injured. 6. According to two injured, whose statements are placed, the applicant has been assigned the role of exhortation only. The third injured has also stated that initially the applicant exhorted the other co-accused to attack the injured, but subsequently, he also attacked. 7. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 8. The bail application is allowed. 9. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
