JUSTICE PRAVEER BHATNAGAR Order 27/08/2025
1. These instant bail applications have been filed under Section 483 of BNSS on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No. 112/2025 registered at Police Station Sadar Bundi District Bundi
(2 of 3) [CRLMB-8191/2025] for the offences under Sections 115(2), 126(2), 110, 352 and 189(2) of BNS. 2. Learned counsels for the petitioners submit that the petitioners have falsely been implicated in this case. It is argued that petitioners also lodged cross case against the complainant party. Petitioner Budhiprakash and his family members Vimla Bai, Devilal, Krishna Kumari and Kishan Gopal also sustained injuries. It is contended that incident occurred suddenly without any premeditation and there was no any murderous intention on the part of the petitioners to cause any fatal injuries to the complainant party. Injuries sustained to injured Harishankar were not opined to be dangerous to life and found to be inflicted by blunt weapon, however in the FIR exaggerated version has been narrated that injuries were caused with the aid of axe and other weapons. The injuries sustained to other injured were also found to be simple blunt in nature. The accused-petitioners are in custody since long and the trial of the case may take considerable time. The charge-sheet has already been submitted before the concerned court, therefore, considering the above facts, these instant bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor opposed these bail applications. 4. Heard and perused the material available on the record. 5.
Considering the arguments advanced by learned counsel for the petitioners and looking to the fact that petitioners are in custody since long and the trial of the case may take considerable time. The charge-sheet against the accused-petitioner has already been submitted before the concerned court and the fact that
(3 of 3) [CRLMB-8191/2025] injuries sustained to injured were neither dangerous to life nor at vital part, without commenting anything on the merits of the case, I deem it proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 of BNSS are allowed and it is ordered that the accused-petitioners
1. Kishan Gopal S/o Chota, 2. Buddhiprakash S/o Shankar Lal,
3. Devilal S/o Surajmal, in connection with FIR No. 112/2025 registered at Police Station Sadar Bundi District Bundi shall be enlarged on bail provided they furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
