HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 7807/2024 Mangla Sen W/o Daulatram, R/o Bakani, P.s. Bakani, Dist. Jhalawar. ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Amit Dadhich For Respondent(s) : Ms. Manju Dave, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 13/01/2025 1. Apprehending his arrest in connection with FIR No. 88/2024 registered at Police Station Ratlai, District Jhalawar for the offence(s) under Section 8/20 of NDPS Act, the accused-petitioner has preferred this anticipatory bail application under Section 438 Cr.P.C. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that there is no evidence available on the record that petitioner was involved in transporting the contraband articles Ganja containing weight of 1.125Kg, which was recovered from the other co-accused Anish Khan who has named the petitioner. Apart from the disclosure statement of Anish Khan, there is no other reliable evidence available on the record regarding culpability of petitioner, there is no criminal antecedents against the petitioner. Petitioner is ready and willing to cooperate with the investigation, therefore, considering the above aspects anticipatory bail of the accused-petitioner may be allowed. (2 of 2) [CRLMB-7807/2024] 3. Learned Public Prosecutor vehemently opposes the anticipatory bail application and submitted the factual report, same is taken on record. 4. Heard and perused the material available on the record. 5. Considering the fact that petitioner has been named by the other co-accused and there is no other evidence available on the record indicating the involvement of the present petitioner, thus, without commenting anything on the merits of the case, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner. 6. Accordingly, the anticipatory bail application under Section 438 Cr.P.C. is allowed and it is ordered that in the event of arrest of the petitioner Mangla Sen W/o Daulatram, in connection with FIR No. 88/2024 registered at Police Station Ratlai, District Jhalawar, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himsel available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court.
