JUSTICE SHAMIMA JAHAN ORDER 29.07.2025 Heard Ms. Ruth Lalruatfeli, learned counsel appearing on behalf of Mr. L.H. Lianhrima, learned Senior Counsel for the petitioner. Also heard Mrs. Linda L. Fambawl, learned counsel for the respondent No. 11. 2. This is an application filed under Rule 9 of the Contempt of Court Page No.# 3/4 (Gauhati High Court) Rules, 1977 read with Section 12 of the Contempt of Court Act, 1971 for non-compliance of the Gauhati High Court’s Judgment & Order dated 13.04.2018 passed in WP(C) No. 53/2014. The direction given in the said order was that the State respondents within a period of one month from the date of receipt of a certified copy, to initiate steps to acquire the land of the petitioner covered by LSC No. 10/1978 as per the law applicable and also to pay him the compensation. 3. This Court further directed that the entire process shall be undertaken as expeditiously as possible and within the outer limit of 5 months from the date of initiating the acquisition proceedings. The said directions were given on 13.04.2018. Thereafter, the said contempt petition was filed on 30.10.2018 and the same was taken up by this Court. 4. On 26.05.2025, when the instant contempt petition was taken up, the learned counsel appearing for respondent No. 11 had placed on record the copies of the awarded amount which has been calculated by the Deputy Commissioner in compliance with the Judgment & Order dated 13.04.2018 passed in WP(C) No. 53/2014. However, the learned counsel for the petitioner on the said occasion had prayed for time to get instructions regarding the said awarded amount as according to the said learned counsel, the copy presented by the concerned respondent was not dated. 5. Today, when the matter is called up, Mrs. Linda L. Fambawl, learned counsel appearing for the respondent No. 11 has placed an order by which it is reflected that proceedings on acquisition of land under the Mizoram (Land Page No.# 4/4 Acquisition, Rehabilitation and Resettlement) Act, 2016 (hereinafter referred to as the said Act, 2016) with regard to the present petitioner in reference to WP(C) No. 53/2014 was initiated. 6. In the said order, it is also reflected that the land value of the said land in question is also determined. By the said order, 100% solatium for the petitioner as per Section 30 sub section 1 of the said Act, 2016 is also considered alongwith 12% interest. Further, by the said order, the compensation fixed at Rs. 23,72,863/- was also given to the petitioner which is also stated by the learned counsel appearing for the petitioner that the petitioner has received that amount. 7. In view of the same, it is noticed that the acquisition proceeding was initiated, the compensation was given and also the process was undertaken as ordered by this Court vide Judgment & Order dated 13.04.2018. 8. Since there is compliance of order stated above, this contempt petition is closed. The contempt petition stands disposed of. JUDGE Comparing Assistant
