ORDER B E F O R E HON’BLE MR. JUSTICE NELSON SAILO 23.01.2025 Heard Mr. C. Lalramzauva, learned Senior counsel assisted by Mr. Stephen Lalbuatsaiha for the petitioner. Also heard Mr. Roshan Subedi, learned counsel appearing for respondent No. 3 and Ms. Zairemsangpuii, learned CGC appearing for respondent No 1. The petitioner has filed the instant Contempt Petition alleging willful and deliberate violation of this Courts Order dated 08.11.2018 passed in WP(C) No. 156 of 2018. Aggrieved with the order passed by this Court, the respondent authorities concerned had approached the Apex Court by filing Special Leave Petition (C) No. 43468/2019 alongwith appropriate application for condonation of delay. The Apex Court vide Order dated 04.01.2024 dismissed the SLP and all the related applications in connection with the SLP. Initially, upon such dismissal there was an attempt on the part of respondent authorities concerned to file a review before the Apex Court. Later on, a decision was taken by the Ministry of Home Affairs, Department of Border Management (BM-I Division) to comply with the direction passed by this Court and the BSF authorities were instructed to comply with the Courts direction vide communication dated 06.01.2025. The said communication has been forwarded to Ms. Zairemsangpuii, learned CGC stating that payment will be made as was

directed by this Court. When the matter was listed on 21.01.2025, taking into account, the instructions received by the learned CGC, Mr. Roshan Subedi, learned counsel for the respondent No. 3 (Chairman and Managing Director, NPCC) was asked to obtain instructions as to when the amount due to the petitioner will be paid. Today, on instructions, the learned counsel submits that the Deputy Commissioner, Lunglei District, Lunglei on 21.01.2025 was asked by the Project Manager, NPCC Limited to furnish the details of the account of the Deputy Commissioner for payment of the amount due to the petitioner i.e. Rs. 8,58,11,747/-. The learned counsel by producing the said communication dated. 21.01.2025 submits that as and when the details of the account of the Deputy Commissioner is received, the NPCC will deposit the amount due as expeditiously as possible at any rate within one (1) month of receipt of the account details. Considering the above development and the submissions made, the instant Contempt Petition stands closed with an understanding that the amount due to the petitioner would be deposited in terms of the instructions received by the learned counsel for respondent No. 3.
