The petitioner is apprehending his arrest in connection with Baliapur P.S. Case No. 96/2024, for the alleged offences registered under Sections 303(2), 317(2), 3(5) of B.N.S., 2023 and Rules 9/13 of the Jharkhand Minerals (Prevention of Illegal Mining, Transportation & Storage) Rules, 2017 Section 4/21 of Mines and Minerals (Development and Regulation Act, 1957, pending in the Court of learned Judicial Magistrate, 1st Class, Dhanbad. 3. Learned counsel appearing for the petitioner submits that petitioner is nothing to do with the loaded coal on Hywa and petitioner is doing job in the Bhowra Colliery. 4. He further submits that the petitioner has got no criminal antecedent as disclosed in Para-15 of the petition. The name of the petitioner has come in this case, as the driver has taken the name of the petitioner. 2025:JHHC:26565 2 5. Learned counsel for the State opposed the prayer and submits that the allegations are there. 6. In view of the above and considering that the petitioner is not having any criminal antecedent as disclosed in Para-15 of the petition and it has been pointed out that the petitioner is working in Bhowra Colliery as clerk and the driver has taken the name of the petitioner, I am inclined to grant anticipatory bail to the petitioner. 7. Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad, in connection with Baliapur P.S. Case No. 96/2024, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023. 8. This Anticipatory Bail Application is accordingly disposed of.
