This is first bail application seeking grant of bail to the Applicant who is in jail since 17.11.2025 in connection with Crime No.727/2025 registered at Police Station Telibandha, District Raipur for the offence punishable under Sections 138, 296,351(2),115(2),191(2) and 140(2) of BNS, 2023. 2. As per prosecution case, on 17.11.2025 a report was lodged by the complainant with the allegation that on 16.11.2025 at about 11 PM when he was at F-Lounge Cube, the present applicant took him in his scooty by force and near Babylon International Hotel he along with his friends assaulted him by hand, fist and kicks. During that period, his 2 other friends also came and they took the complainant in a Car and near Jora Main Road they again assaulted him by hand, fist and kicks due to which he received injuries. The police registered the offence and investigation is going on in which the applicant has been arrested. 3. Learned Counsel for the applicant would submit that the applicant is a Vth Semester student of B. Pharmacy studying at Raigarh College of Pharmacy. There was some dispute with the complainant with respect to classroom affairs as the complainant was also one of the student of same school from where applicant studied. The complainant has not received any grievous injury and on the trivial issue simple altercation took place between them. He would further submit that examination of Vth Semester B. Pharmacy is scheduled from 5th January, 2026. There is no criminal antecedent against the applicant. Two other co-accused have already been released on bail by the trial court itself. Therefore, the applicant may also be released on bail as final adjudication may take sometime. 4. On the other hand the counsel for the State opposes the bail application and have submitted that the manner in which the applicant and his friend assaulted the complainant, the applicant is not entitled for bail. 5. The counsel for objector have no objection in granting bail to the applicant. 6. Without commenting on merits, considering the totality of the facts and circumstances of the case, the nature of allegation and material collected during investigation, the nature of injury received by complainant, considering the fact that applicant is a student of Vth 3 Semester B. Pharmacy and semester examination is scheduled from 5th January, 2026 and also considering the fact that two other co- accused persons have already been released on bail by the trial court, this Court is of the opinion that present is a fit case where the Applicant can be enlarged on bail. 7. Accordingly, the application for grant of bail is allowed. It is directed that the Applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety of the like sum to the satisfaction of the concerned Trial Court for his appearance on each date of hearing before the trial Court, unless exempted from personal appearance by the said Court. 8. It is made clear that the observations made by this court is only restricted to the decision of bail application and shall not affect the merits of the case.
