Versus
1. The State of Jharkhand
2. Mala Devi, D/o Anirudh Pandit, resident of village Pathargama, P.O and P.S. Pathargama, District- Godda, Jharkhand . … Opp. Party(s). ------ CORAM :
SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Md. Zaid Ahmed, Advocate. For the State : Ms. Mahua Palit, A.P.P. For the Informant: Mr. Manoj Kr. Sah, Advocate. …..... 03/24.04.2025 This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of the Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023, as the petitioner has been allegedly implicated in a criminal case registered under Section(s) 341, 323, 307, 498A and 34 IPC, Sections 3/ 4 of the Dowry Prohibition Act in connection with Patharmaga P.S. Case No. 49/2023, pending in the court of learned SDJM, Godda. Heard learned counsel for the parties at length and had gone through the documents, annexed along with this application. Opportunity was given to the State and the informant to oppose the bail, which they availed and vehemently opposed but the informant cannot deny the fact that the chargesheet has been submitted in this case. The petitioner is the husband and there is an allegation of torture and demand of dowry against him. Whatever may be the facts of this case, but it has come during the course of arguments and it has been accepted by both the parties that chargesheet has been submitted against the petitioner under Sections 341, 323, 498A IPC and 3/ 4 of the Dowry Prohibition Act. Submission of the chargesheet against this petitioner clearly suggests that the petitioner has co-operated during the investigation thus there was no necessity to arrest him. Considering the aforesaid facts, the petitioner is directed to appear before the Court concerned and furnish his bail bond(s). Accordingly, this application disposed of. Anu/-C.P.-3
