This Cr.M.P. under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been preferred against the order dated 14.07.2025 passed by learned Sessions Judge, Latehar in Criminal Revision No. 46 of 2024 whereby the revision petition filed by the petitioner against the order dated 17.10.2024 passed by the learned Judicial Magistrate 1st Class, Latehar has been dismissed as not maintainable. Further prayer has been made for quashing of order dated 17.10.2024 passed by the learned Judicial Magistrate 1st Class, Latehar in connection with Garu P.S. Case No. 11 of 2013 corresponding to G.R. No. 274 of 2013 in which charge has been framed under Section 409 of the Indian Penal Code inter alia against the petitioner and whereunder learned Magistrate has allowed the prayer of prosecution made invoking jurisdiction under Section 311 of the Code of Criminal Procedure and at present the case is pending in the Court of learned Judicial Magistrate 1st Class, Latehar. Learned counsel for the petitioner submits that the petitioner does not want to press this Cr.M.P. and he further submits that the prosecution be directed to conclude the examination of witnesses on a date to be fixed by the trial court in terms of the order dated 17.10.2024 in connection with G.R. Case No. 274 of 2013. 4. Considering the aforesaid facts, this Cr.M.P. stands disposed of with a direction to the learned trial court to fix a date for examination of witnesses of the prosecution in terms of the order dated 17.10.2024 in connection with G.R. Case No. 274 of 2013 and it is directed that no adjournment shall be given in connection with the aforesaid case. 5. Registry is directed to intimate the Court concerned forthwith.
