JUSTICE A. GUNESHWAR SHARMA O R D E R 10-12-2025 [1] Heard Mr. K. Pradeep, learned counsel along with Mr. Ch. Nripenchandra, learned counsel for the petitioners and Mr. Niranjan Sanasam, learned Government Advocate for the State respondents appearing through video conferencing. [2] By the present writ petition, the three petitioners approached this Court for disposing of the representations at Annexure-A/2, A/3, A/8 and A/10 for allotment of land to them as directed by this Court in WP(C) No. 868 of 2001 vide order dated 12-11-2018 in C.S. Dag No. 643 of Village No. 11 Laipham Siphai, Porompat. The prayers are reproduced hereinbelow:— “1. Direct the Respondent No. 3 to dispose the Representations of the Petitioners (Annexure A/2, A/3, A/8 and A/10) for allotment of the land to the petitioners as directed by the High Court of Manipur in WP(C) No. 868 of 2001 dated 12/11/2018 in Annexure A/1. WP(C) No. 353 of 2024 & MC(WP(C)) No. 308 of 2024 2. The proposed allotment of any land for the proposed sewage plant inside the Dag No. 643 (Annexure A/4, A/5, A/6 and A/9) may be kept in abeyance till the allotment process in favor of the petitioners are completed and directions be given to the Deputy Commissioners Imphal East (Respondent No. 3). 3. A direction be given to the Respondents not to enter upon the land covered under C.S. Dag No. 643 till the allotment matter of the writ petitioners is disposed by this Hon’ble Court. 4. In the interim, the allotment/construction if any of the Sewage Treatment Plant inside the Dag No. 643 may be kept in abeyance till the allotment process of the writ petitioners are completed. 5. Any order/directions be passed which the Hon’ble Court may deem fit and just in the present circumstances of the case.” [3] Mr. K. Pradeep, learned counsel for the petitioners, submits that in spite of the order dated 12-11-2018 passed by this Court in WP(C) No. 868 of 2001, the process of allotment of the three pieces of land to the petitioners has not been completed and in the circumstances, the petitioners are compelled to approach this Court for the second time for the same prayer. [4] However, Mr. Niranjan Sanasam, learned Government Advocate for the State respondents, draws the attention of this Court to the letter dated 17-08-2023 written by the Deputy Commissioner, Imphal East to the Secretary (Land Resources), Government of Manipur, indicating that the land has been identified for allotment to the petitioners from Dag No. 643 having a total area of 0.65 acre under Revenue Village No. 11-Laipham WP(C) No. 353 of 2024 & MC(WP(C)) No. 308 of 2024 Siphai, Porompat. Williamsom 0.18103 [5] It is stated that after earmarking of the portion of the land proposed to be allotted to the petitioner, 0.2966 acre of land still remains and the same can be allotted for the purpose of sewage plant under “Integrated Sewerage System for Imphal City Phase-II”. [6] Mr. Niranjan Sanasam, learned Government Advocate for the State respondents, submits that the process for allotment is under active consideration and the writ petition may be disposed of at this stage as the allotment order may be issued at any time. [7] Mr. K. Pradeep, learned counsel for the petitioner, submits that the representations may be disposed of in terms of the letter dated 17-08-2023 issued by the Deputy Commissioner, Imphal East with a rider that the allotment order be issued within a stipulated time. [8] This Court has considered the material on record. It appears that from the letter dated 17-08-2023 issued by the Deputy Commissioner, Imphal East to the Secretary (Land Resources), Government of Manipur about the earmarking of the land to be allotted to the three petitioners and also sufficiency of land for allotment for sewage plant in view of the contents of the letter dated 17-08-2023, the writ petition is disposed of by directing the State respondents to consider and complete the allotment process within a period of three months from the date of receipt of a copy of this order. WP(C) No. 353 of 2024 & MC(WP(C)) No. 308 of 2024 [9] After an order is dictated, the learned Government Advocate for the State respondents, submits that he may be permitted to file counter affidavit. When the matter is disposed of, there is no requirement of filing counter affidavit. [10] Send a copy of this order to the Deputy Commissioner, Imphal East for information and taking necessary action. [11] MC(WP(C)) No. 308 of 2024 is also disposed of in terms of the order passed by this Court in WP(C) No. 353 of 2024.
