O R D E R This writ petition is filed challenging the impugned proceedings of the respondent University in Proc.No.275/WU/Rr/Relieving order/2025 dated 31.07.2025 and seeking consequential direction to the respondent to extend the service of the petitioner as Professor in the respondent University till the end of the academic year 2025 - 2026 with all other attendant benefits. 2. I have considered the submissions made on either side and carefully perused the materials available on record. 3. The challenge in the writ petition is to an order refusing to relieve the petitioner from service who had been working as a Professor in the Department of Education. As per the statutes of University, particularly clause 21, the academic staff shall retire at the age of 60 and if the date of superannuation falls during the middle of the year, they can 2/6 https://www.mhc.tn.gov.in/judis W.P.(MD).No.25657 of 2025 reemployed till the end of the academic year till 31.05.2025. However, without reemployment, the petitioner had been relieved from service on 31.07.2025, which falls in the middle of the academic year. Such reliving is contrary to clause 21 of the Statutes of the respondent University. 4. The learned Standing Counsel appearing for the respondent University on instructions would submit that the petitioner had been relieved on 31.07.2025 upon attaining the age of superannuation. As the Finance Committee in its meeting held on 20.02.2024, after reviewing the fiscal status of the respondent University directed that the extension beyond the date of superannuation is not permitted because of the financial constraint faced by the University and therefore, the petitioner was not reemployed. The Finance Committee cannot take any decision contravening the statutes of the university. The statutes of the University are to be strictly followed by the respective committees of the university including the syndicate, unless or until the same is amended in the manner known to law. 3/6 https://www.mhc.tn.gov.in/judis W.P.(MD).No.25657 of 2025 5. In view of the same, the reasonings attributed for non-reemployment of the petitioner given by the respondent cannot be accepted by this Court. In fine, the respondent is directed to reemploy the petitioner till the end of the next academic year namely 31.05.2026. 6. This writ petition is disposed of with the above directions. No costs.
