respondents 1 & 2 to restore the revenue records in the name of the petitioner's father namely Periaiah Servai. For Petitioner : M/s.M.Gnanagurunathan For Respondents : Mr.B.Saravanan Additional Government Pleader for R1 to R3 Mr.S.M.Anantha Murugan for R4
ORDER The petitioner asserts that he is the son of late Periyaiyya, whose name is reflected in the pre-UDR revenue records relating to the lands described in paragraph 2 of the affidavit in support of the writ petition. 2. Learned counsel for the petitioner submits that in spite of submitting a representation dated 23.07.2019 to the District Revenue Officer seeking correction of the UDR error, no action has been taken till date. 3. In response to the said contentions, learned counsel for the 4th respondent relies on the type set of documents filed on 13.10.2022. In particular, with reference to lawyer's notice dated 04.09.2019, he points out that such notice was issued not only to the 4th respondent but to 6 other persons. He also points out that the petitioner has referred to multiple conveyances that were 2/6 https://www.mhc.tn.gov.in/judis
effected in respect of the relevant property. He submits that the purchasers of portions of the property have put up constructions thereon. By also referring to reply dated 29.09.2019 to the lawyer's notice, learned counsel submits that the petitioner was informed that, if aggrieved by the conveyances, the petitioner should approach the jurisdictional civil court for relief. 4. On perusal of lawyer's notice dated 04.09.2019, it is evident that such notice has been addressed to Solaimalai, Kasinathan, Meiyappan, Visalakshi, Ram Chitra, Kothai and Meenal. The notice, at paragraph 3 thereof, makes reference to multiple conveyances, such as conveyances under document Nos. 2247/2015, 2246/2015, 316/2016, 836/2012, 837/2012, etc. Given that the petitioner is aware of multiple conveyances purportedly on the basis of oral partition, which was acted upon, the petitioner should challenge the same by approaching the jurisdictional civil court. Instead, by approaching the District Revenue Officer, the petitioner seeks relief before this court. 5. The documents on record indicate that there is a dispute relating to title and revolving around an oral partition which prima facie appears to have been acted upon. In these circumstances, relief claimed by the petitioner cannot be granted. By leaving it open to the petitioner to approach the jurisdictional civil 3/6 https://www.mhc.tn.gov.in/judis
