2/17.07.2025 Heard Md. Zaid Ahmed, learned counsel appearing for the appellant and Mr. Bhola Nath Ojha, learned Spl.P.P. appearing for the State.
2. This appeal has been directed against the order dated 12.07.2024 passed by the learned Additional Sessions Judge, III, Dhanbad in S.T. No. 890 of 2023(MCA No. 1806 of 2024); whereby and whereunder the prayer for bail of the appellant has been rejected.
3. It appears that the appellant has earlier moved for grant of bail before this Court in Cr. Appeal (DB) No. 129 of 2024 which however was rejected vide order dated
13.05.2024.
4. It has been submitted that the appellant is in custody since 23.08.2023 and out of 8 chargesheet witnesses only 1 witness has been examined till date.
5. Learned Spl. P.P. has opposed the prayer for bail of the appellant.
6. Regard being had to the period of custody undergone by the appellant we while setting aside the
order dated 12.07.2024 passed by the learned Additional Sessions Judge, III, Dhanbad in S.T. No. 890 of

2023(MCA No. 1806 of 2024), the appellant above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Additional Sessions Judge, III, Dhanbad in S.T. No. 890 of 2023(MCA No. 1806 of 2024), subject to the condition that the appellant shall remain physically present before the learned trial court on each and every date till conclusion of the trial.
7. Accordingly, this appeal is allowed.
