Page No.# 2/2 – B E F O R E – HON’BLE THE CHIEF JUSTICE MR. VIJAY BISHNOI HON’BLE MR. JUSTICE KARDAK ETE 27-05-2025 (Vijay Bishnoi, CJ) This PIL petition is filed praying for the following reliefs:-
“i. Issue a writ of Certiorari, or any other appropriate writ, order or direction, against Respondent No.1, thereby setting aside its Notification No.HMA-19019(11)/1/2018-Political(A)/84, dated 11.12.2019, and similar subsequent Notifications, issued for suspension of internet services in eight districts of Assam; ii. Issue a writ of Mandamus, or any other appropriate writ, order or direction, thereby declaring the Temporary Suspension of Telecom Services (Public Emergency or Public Safety) Rules, 2017, to be unconstitutional and ultra vires the provisions of the Indian Telegraph Act, 1885.” Mr. A. Gautam, learned counsel for the petitioner has submitted that with the enactment of the Telecommunications (Temporary Suspension of Services) Rules, 2024 vide Notification dated 22.11.2024 published in the Gazette of India, the challenge made by the petitioner to the impugned Notification as well as the impugned Rules has become infructuous. In view of the above, this PIL petition stands dismissed as infructuous.
