1. This is the second bail application for grant of bail filed under Section 483 of the Bharatiya Nagrik Suraksha Sanhita, 2023 (for short “BNSS”) by the applicant who is in custody in connection with Crime No. 317/2022 registered at Police Chowki – Baloda, Police Station – Saraipali, District - Mahasamund (C.G.) for the offence punishable under Section 376 (A) (B), 342, 506, 34 of IPC and section 4 of the Protection of Children from Sexual Offences Act, 2012. The first bail application was dismissed by this Court on 13/10/2022 in M.Cr.C. No. 8325/2022.
2. The case of the prosecution is that the applicant committed sexual inter- course with the minor prosecutrix.

Learned counsel for the applicant submits that applicant the applicant is in jail since 10/08/2022 and trial is not concluded as yet. There are total 24 witnesses projected in the charge-sheet and 20 witnesses have been examined. 4. Learned State counsel opposes the submissions.
5. Heard counsel for the parties and considered their rival submissions.
6. After hearing learned counsel for the parties, on perusal of the case diary, this Court is not inclined to admit this application. However, looking to the detention period of the applicant it is expected that trial court would do all the endevours to deicide the case expeditiously preferably within a period of four months from the date of receipt of copy of this order.
7. Accordingly, this M.Cr.C. is dismissed.
