2/12.08.2025 Heard learned counsel appearing on behalf of the Petitioners and learned APP appearing on behalf of the State.
2. The petitioners are apprehending their arrest in connection with Complainant Case No.163 of 2018, for the alleged offences registered under Section 33 of Indian Forest Act and Sections 3 & 4 of Forest Conservation Act, pending in the Court of learned Chief Judicial Magistrate, Chatra.

Learned counsel for the petitioners submits that 12 persons have been accused in the FIR and the allegations are made that in 25 acres of forest land, poppy plants have been cultivated.
4. He submits that the petitioners have nothing to do with the cultivation of the poppy plants and seven co-accused persons have been granted anticipatory bail in ABA No.2182 of 2025 by order

dated 03.04.2025.
5. He further submits that the petitioners are not having any criminal antecedent as disclosed in Para-14 of the petition.

Learned counsel for the State opposed the prayer and submits that the allegations are there of cultivating the poppy plants.
7. Considering that the petitioners are not having any criminal antecedent as disclosed in Para-14 of the petition and seven co- accused persons have been granted anticipatory bail in ABA No.2182 of 2025, I am inclined to grant anticipatory bail.
8. As such, the petitioners above named are directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of their surrender / arrest, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) each with two sureties of the like amount of each to the satisfaction of learned Chief Judicial Magistrate, Chatra, in connection with Complainant Case No.163 of 2018, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023.
9. This Anticipatory Bail Application is accordingly allowed and
disposed of.
