THIS PETITION, COMING ON FOR FINAL HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner has sought for the following relief:- “ a. Issue an appropriate writ, order or direction quashing the First Information Report dated: 05.04.2024 in Crime No. 0057 of 2024 registered by the Respondent No. 1/ Bharathi Nagar Police Station for the offences punishable under Sections 342, 323, 506 of the Indian Penal Code, 1860 and Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015 pending on the file of the x Additional Chief Metropolitan Magistrate, Mayo Hall, Bengaluru, qua the petitioner (Annexure-A); and b. Pass/issue such other directions/ orders in favour of the petitioners under the circumstances of the case to meet the ends of justice.” - 3 - NC: 2025:KHC:2784 WP No. 11207 of 2024 2. Learned counsel for the petitioner - accused has filed a Memo dated 22.01.2025 duly signed by counsel for the petitioner. 3. Both petitioner and respondent No.2 have appeared through Video Conferencing and they admit the contents of the aforesaid Memo, which reads as under:- “The counsel for the petitioner is herewith producing the copies of the Final Order passed in W.P. (H.C.) No.42/2024 and the Memorandum of Settlement entered between the Petitioner and the 2nd Respondent for the Kind perusal of this Hon’ble Court. In terms of Clause 6(A) (iv) & (B) of the aforementioned Memorandum of Settlement, the Respondent No.2 has agreed to co –operate with the Petitioner for quashing of the Impugned First Information Report in Crime No. 57/2024 registered by the 1st Respondent for the offences punishable under Sections 342, 323 and 506 of the Indian Penal Code, 1860 and Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015. Wherefore, it is humbly prayed that this Hon’ble Court be pleased to place this Memo on record and Allow the captioned Petitioner, to meet the ends of Justice.” 4. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following: - 4 - NC: 2025:KHC:2784 WP No. 11207 of 2024 ORDER (i) Petition is disposed of in terms of the Memo dated 22.01.2025. (ii) The proceedings in Crime No.57/2024 registered by 1st respondent – Police for the offences punishable under Sections 342, 323 and 506 of IPC and Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015, pending on the file of X Additional Chief Metropolitan Magistrate, Mayo Hall, Bengaluru, insofar as the petitioner is concerned are hereby quashed.
