Sahay, A.P.P. ---- 02/14.08.2025 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State. 2. The petitioners are apprehending their arrest in connection with Pakur (T) P.S. Case No. 189 of 2024, for the alleged offences registered under Sections 310(2)/312/308(5)/308(4)/351(3) of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of Learned Chief Judicial Magistrate, Pakur. 3. Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR and the name of the petitioner has come on the confessional statement of the co-accused. He further submits that the name of the petitioner has come in the investigation, however, no amount has been received in the account of the petitioner. He also submits that the co-accused have been granted anticipatory bail in A.B.A. No. 6824 of 2024 and A.B.A. No. 7067 of 2025:JHHC:23875 --2-- A.B.A. No. 4429 of 2025 2024 and A.B.A. No. 7565 of 2024. He submits that the allegations are made that the amount in question has come into the account of the petitioner, however, in the FIR the document which has been annexed clearly suggests that the said amount has been transferred in the account of Shyam Thakur, who has been granted anticipatory bail. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegation of demand of amount is there. 5. Considering that the allegations are made that the amount in question has been transferred to the account of the petitioner, however, it is said to be transferred in the account of Shyam Thakur who has already been granted anticipatory bail and in the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Pakur in connection with Pakur (T) P.S. Case No. 189 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Rashmi/
