CRL OP(MD). No.16757 of 2025
ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 420 of IPC, in Crime No.47 of 2025 on the file of the respondent police, seeks anticipatory bail. 2. The case of the prosecution is that the petitioner, along with other accused, cheated the de-facto complainant by failing to hand over the jewel-pledge receipt, which had been obtained after pledging gold jewels weighing 125 grams in Canara Bank, thereby preventing the de- facto complainant from redeeming the jewels. Hence, the complaint. 3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offences as alleged by the prosecution, and she has been falsely implicated in this case. He further submitted that due to a family dispute, a false case has been given against the petitioner. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail for the petitioner. 2/5 https://www.mhc.tn.gov.in/judis

4. The learned Government Advocate (Criminal Side) submitted that there are two accused persons in this case and that the petitioner has been arrayed as A1, and that this is the second anticipatory bail application filed before this Court. He further submitted that the petitioner, along with other accused, cheated the de-facto complainant, and that the investigation is at initial stage. Hence, he opposed the grant of anticipatory bail to the petitioner. 5. The learned counsel for the intervenor submitted that the earlier anticipatory bail application filed by the accused in Crl.O.P.(MD) No.3652 of 2025 was dismissed as withdrawn on 12.08.2025. He further submitted that, till date, the accused has not approached the de-facto complainant for the redemption of her jewel. Hence, he strongly opposed the grant of anticipatory bail to the petitioner. 6. This Court already referred the matter to the Mediation and Conciliation Centre attached to this Bench. A report dated 07.11.2025 has been received from the Mediation Centre stating that no agreement was reached. 3/5 https://www.mhc.tn.gov.in/judis

7.
Considering the facts and circumstances of the case, and also the fact that till date, the accused persons have neither retuned the jewels nor the amount, and that the investigation is still at initial stage, this Court is not inclined to grant anticipatory bail to the petitioner at this stage. 8.
