ORDER 10.06.2025 Heard Mr. A. K. Jain, learned counsel for the appellant and Mr. B. Sharma, learned Additional Public Prosecutor, Assam for the State. 2) Being aggrieved by the judgment and order of conviction and sentence dated 07.08.2019 passed by the learned Special Judge (POCSO), Karbi Anglong at Diphu in POCSO Case No. 24/2018 (Special Case No. 38/2018), arising out of Dokmoka Police Station Case No. 38/2018, corresponding to G.R. No. 803/2018, the appellant, namely, Sri Jailsing Baglary has filed this criminal appeal on 28.11.2019; whereby, the appellant was convicted under Section 363 IPC read with Section 4 of the POCSO Act, 2012 and was sentenced to undergo Rigorous Imprisonment for 6 months under Section 363 IPC and Rigorous Imprisonment for 8 years with fine of Rs. 1000/- in default, Simple Imprisonment for 2 months for offence under Section 4 of the POCSO Act, 2012. 3) By order dated 02.12.2021, this appeal was admitted for hearing and the records of said POCSO Case No. 24/2018 (Special Case No. 38/2018), arising out of Dokmoka Police Station Case No. 38/2018, corresponding to G.R. No. 803/2018 was called for from the Court of the learned Special Judge (POCSO), Karbi Anglong at Diphu. 4) During the deliberation of the matter, Mr. Jain, learned counsel for the accused appellant placed a copy of the Release Certificate issued by the Jailor of Distrit Jail, Diphu dated 17.05.2025 certifying that the present appellant, who was convicted with 8 years of Rigorous Imprisonment with fine of Rs. 1000/- in default, Simple Imprisonment for 2 months in connection with said POCSO Case No. 24/2018 (Special Case No. 38/2018), arising out of Dokmoka Police Station Case No. 38/2018, corresponding to G.R. No. 803/2018 has been released on 17.05.2025 on expiry of sentence, payment of fine, setting off the hazot period and on getting 668 days remission. 5) As such, Mr. Jain, learned counsel for the appellant prays for withdrawal of this appeal including the interlocutory application filed along with this appeal, being I.A. (Crl.) No. 176/2021, as the appellant has already served his sentences; to which, Mr. B. Sharma, learned Additional Public Prosecutor, Assam has no objection. Page No.# 3/3 6) Accordingly, this criminal appeal, being withdrawn, stands closed. 7) The copy of the communication dated 17.05.2025 of the Jailor, District Jail, Diphu, placed before the Court today by Mr.
Jain, learned counsel for the appellant pertaining to the release of the appellant on 17.05.2025 in said POCSO Case No. 24/2018 (Special Case No. 38/2018), arising out of Dokmoka Police Station Case No. 38/2018, corresponding to G.R. No. 803/2018 be kept as a part of the record. 8) Registry shall return the records of POCSO Case No. 24/2018 (Special Case No. 38/2018), arising out of Dokmoka Police Station Case No. 38/2018, corresponding to G.R. No. 803/2018 to the Court of the learned Special Judge (POCSO), Karbi Anglong at Diphu along with a copy of this
order and a photocopy of the Release Certificate, issued by the Jailor, District Jail, Diphu dated 17.05.2025, noted above. 9) This order be brought to the notice of the Registrar (Judicial).
