1. These matters are listed today in the "to be mentioned category". It was brought into notice to the Court by counsel for the complainant that inadvertently the appeal of Ramprakash @ Prakash has been allowed whereas, his name was mentioned in the FIR. It is contended that the order passed by this Court on 21.01.2025, granting bail to the Ramprakash @ Prakash may be altered and his bail application may be dismissed with the liberty as granted to the other co-accused Ghanshyam.
Similarly, it is also brought into notice to this Court that appeal of Mahaveer was dismissed with liberty to file afresh, after recording of the statements of witnesses Sorang, Tejmal and the medical jurist who has given opinion regarding injuries sustained to injured Sorang whereas, the allegations are against the other co-accused not against Mahaveer, therefore, the order passed by this Court in S.B. Criminal Appeal No.215/2025 may be altered with regard to the accused Mahaveer and his appeal may be allowed as in parity with the other co-accused Geetaram @ Kacholya and Chhotu Lal. [2025:RJ-JP:3232] (3 of 4) [CRLAS-92/2025]
2. Heard and perused the order passed in S.B. Criminal Appeal Nos.92/2025 and 93/2025 and in S.B. Criminal Appeal Nos.215/2025 and 216/2025. 3. These all appeals are connected with the same FIR i.e. FIR No.96/2024 registered at Police Station Banetha, District Tonk. This Court heard all the appeals and inadvertently in the order passed in appeal No.92/2025 instead of dismissing the bail application of Ramprakash @ Prakash his bail application has been allowed whereas, his case was similar to the case of the other co- accused Ghanshyam, whose appeal (bail application) was dismissed with the liberty to file afresh after recording of the statements of witnesses, therefore, upto the extent of Ramprakash @ Prakash, the order of granting bail is recalled and his appeal is dismissed with liberty as granted to the other co- accused Ghanshyam in appeal No.216/2025. 4. Similarly, inadvertently instead of granting bail to Mahaveer, his appeal was dismissed along with the other co-accused Ghanshyam, whose bail application was dismissed vide order dated 21.01.2025 passed in the appeal Nos. 215/2025 and 216/2025. 5. As a result, the appeal (bail application) of the appellant Mahaveer is hereby allowed. The impugned order dated 08.01.2025 passed by the learned Special Judge, SC/ST (Prevention of Atrocity Cases), Tonk is set aside.
It is ordered that the accused-appellant Mahaveer S/o Shri Baluram, who is in custody in connection with F.I.R. No.96/2024 dated 08.06.2024, registered at Police Station Banetha, District Tonk shall be released on bail; provided he furnishes a personal bond in the sum
[2025:RJ-JP:3232] (4 of 4) [CRLAS-92/2025] of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so. 6. The appeal (bail application) of Ramprakash @ Prakash is dismissed with the liberty to file afresh after recording of the statements of witnesses Sorang, Tejmal and the medical jurist who has given opinion regarding injuries sustained to injured Sorang. 7. This order shall be a part of the earlier orders passed in S.B. Criminal Appeal (Sb) Nos.92/2025, 93/2025, 215/2025 and 216/2025 dated 21.01.2025. 8. A copy of this order be seperately placed in each matter. (PRAVEER BHATNAGAR),J Keshav/33-34
