PUBLIC PROSECUTOR The Court made the following; 9 ORDER:- The Criminal Petition, under Section 438 of the Code Procedure, 1973 grant anticipatory bail i Excise Station, Chittoor Urban District. A case has been offence punishable u/Sec.7(B) Amendment Act, 2020. The case of the prosecution is that: of Criminal is filed on behalf of the petitioners/accused Nos.2 & 3 to in connection with Crime No.83/2025 of Prohibition & 2) registered against the petitioners r/w 8(A), 8(C)(a) of herein for the A.P.(Prohibition) 3) On 02.06.2025 at about 5.30 P.M., preparation of illicitly distilled liquor, the Prohibition Chittoor Urban, along with their Gurralamitta area, Gudipala Mandal, on reliable information about illegal and Excise Sub-Inspector, staff and mediators, conducted a raid at were found On seeing the officials from a removed the tubes and escaped on a motorcycle. The police caught A1 at the spot and seized two black rubber tubes containing 30 liters drums with 400 liters of fermented i liquor. where the accused A1 to A3 near a ZR vehicle with two black rubber tubes, distance, A2 ran away into the bushes and A3 of ID liquor and also found blue plastic jaggery wash meant for making illicit 4) Heard. Perused the record. Learned counsel for the petitioners submits that the case against the petitioners is based on the suspicion and requested the Court to enlarge them on bail. 6) Learned Assistant Public Prosecutor opposed to grant bail and also on instructions submitted that the petitioner No.l has got 2 antecedents and petitioner No.2 has got 3 antecedents. A perusal of the occurrence report shows that names of the petitioners have been mentioned and even according to the prosecution's case, on seeing the police the petitioners absconded from the scene of offence. As such, it cannot be said that the case is based on suspicion. Considering the above facts, this Court is not inclined to grant anticipatory bail to the petitioner.
