2. This application has been filed under Section 528 of the BNSS, 2023 in respect of PRC No.173/2024 pending in the court of learned Judicial Magistrate First Class, Dhubri.
3. The petitioner has been shown as an absconder in the charge sheet.
4. Now, he submits that he wants to contest the case.
5. I have gone through the FIR. I have also considered the submissions made by the learned counsel for both the parties.
6. Since, the petitioner is interested in facing the trial, he deserves to be given adequate opportunity to defend his case. Therefore, his application is allowed.
7. The order directing issuance of Bailable Warrant of Arrest against the present petitioner Saha Alam Bepari @ Nur Alom Sk is set aside.
8. The petitioner Saha Alam Bepari @ Nur Alom Sk is directed to appear before the trial court i.e. learned Judicial Magistrate First Class, Dhubri on 11.02.2026. On his appearance, the petitioner shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the said court i.e. learned Judicial Magistrate First Class, Dhubri.
9. The petitioner Saha Alam Bepari @ Nur Alom Sk shall regularly appear before the trial on each and every date as fixed by the learned trial court. If he fails to do so, the trial court shall have the authority to procure his attendance by following due process of law. With the above direction, the present criminal petition is disposed of.
